What Is Personal Data?

Personal data is defined by the UK GDPR and the Data Protection Act 2018 (collectively, “the Data Protection Legislation”) as ‘any information relating to an identifiable person who can be directly or indirectly identified by reference to an identifier’. How do we store your personal data?

(“we, us”) Our website is located within the United Kingdom, and we comply with the internet laws applicable to the United Kingdom which includes General Data Protection Regulation. Your data will be processed within the United Kingdom. We may store and control some of your personal data in the UK. This means that it will be fully protected under the Data Protection Legislation. We may also transfer your data to a third-party service provider which requires your data to be transferred outside of the EU. AND/OR store some of your personal data within the European Economic Area (the “EEA”). The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein. This means that your personal data will be fully protected under the EU GDPR and/or to equivalent standards by law. Transfers of personal data to the EEA from the UK are permitted without additional safeguards.

We also store electronic records which are stored on password  protected computers and secure cloud storage. Our cloud providers are GDPR compliant.  Your data is secure in the cloud-based system. We also use a passcode system for any Form’s we send to you online and a two-factor authentication for added security sometimes. Your data is encrypted in flight navigation and runs on 256-bit SSL Encryption.

We may also store Physical records of tasks and forms identified with code numbers that may be filled in during the course of our business and providing and meeting our contractual obligation to you. These are locked in a cupboard with a key system.

We will take the necessary steps to ensure that your data is treated securely and in accordance with this privacy policy. By agreeing to us using your personal data, you agree to this transfer and, storing and or processing. We will use and take the necessary steps and procedures / security features to try to prevent unauthorised access.

What personal data do we process and collect from you?

We may collect and process personal data that you provide to us by your contact details which may include your name, date of birth, email address, phone number business contact details, correspondence address, IP address. We shall process this data for the purpose of communicating with you and keeping our records on the lawful grounds of legitimate interest. Information contained in emails, requesting information through our contact forms, text or through our website and or other online platforms and social media. Also records of consultations and coaching/meetings held with you. We may also ask you to fill in our evaluation forms after receiving coaching from us. The personal data we hold will be held by us to enable us to get in touch with you.

Details of Transactions that you carry out with us for services that we provide. We may keep appropriate records in connection with the services we provide. This may include personal information, billing address, credit card or other payment details we shall always process this on contractual grounds.  Also, user information this may include comments or statements that you may make or post via our website, online platforms or social media channels, images, documents, or videos that you share on or through our website or through any pages or online platforms and information concerning your use of our website or other online platforms such as your browser information, pixel ID, page views, pages visited, number of visits and where appropriate log-in details. We will process this information to analyse and monitor usage and content of our website and other platforms and channels to ensure the content is relevant to you, to support our administration and record keeping requirements and to maintain security of our systems on legitimate grounds.

In accordance with the Privacy and Electronic Communications Regulations (PECR) we may also send you relevant advertisements or marketing information if you have ever purchased or enquired about our services and at the time of our service you agreed to receive advertising or marketing information from us and did not opt out. If we contact, you through email we shall ensure that our emails clearly display the location of the sender and include clear options to opt-out if you wish to do so in accordance with the CAN-SPAM act.  We shall only collect and process your personal data for purposes that are clearly outlined prior to you providing us with your data or for a legitimate reason. This will be based on a lawful condition, that will be because you have given your consent for us to process your data.

The lawful basis under the Data Protection Legislation that allows (“we, me”) to use such information is article 6(1)(f) of the UK GDPR which allows  (“we, me” ) to process personal data when it is necessary for the purposes of  (“we, me” ) legitimate interests in this case, the proper operation and functionality of (“we, me”) Site. If you contact (“we, me”) as described above, you will be required to consent to use of your personal data to contact you. In this case (“we, me”) lawful basis for using your personal data will be article 6(1)(a) of the UK GDPR, which allows (“we,  me”) to use your personal data with your consent for a particular purpose or purposes. To raise invoices and arrange payment with us. To provide you with our services and carry out your instructions. To provide you with information about any future events we may have, changes to our services, updates and blogs, where you have agreed to be contacted for such purposes. To maintain our obligation to provide you with any or in relation to any contracts we have agreed between us. To perform booking and relevant administrative functions when you reserve a place at one of our events. Any other purpose that may be permitted or required and applicable by law. To carry out any other purpose which is disclosed to you and to which you agree. Where (“we, me”) collect any personal data, it will be processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. As stated above (“we, me”) do not generally collect any personal data directly from you, but if you contact (“we, me”) may obtain your personal details from your email, (“we, me” ) may use them to respond to your email. The other technical data referred to above is necessary for the technical operation of (“we, me”) site and will not normally be used in any way to personally identify you.

Retention of Data

(“we, me”) will not keep your personal data for longer than is required regarding the purpose for which it was collected by us generally 7  years, including any legal obligations, or record keeping requirements and (“we, me”) will take reasonable steps to destroy or permanently de-identify your personal data when it is no longer required. No personal data will be retained for any longer than is necessary. (“we, me”) will not share any of your personal data with any third parties for any purposes other than storage on an email and/or web hosting server. When we process your data, we will always adhere to and comply with the relevant data protection laws and principles, which means that your data will always be used lawfully and in a transparent way always kept securely and only for as long as necessary for the purposes we have told you about.

With any other member of our company who might need to work with you. Where we might outsource a function or activity to an external provider, we will only disclose the personal information that the provider needs to undertake that function or activity and we also require that external service providers agree to keep your personal data secure and in accordance with the relevant law.

You have a right in relation to the details we hold and can request the data that Empowering Mind Therapies holds in relation to discussions/ meetings held with you. If you want to know what personal data (“we, me”) have about you, you can ask (“we, me”) for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”. You have the right to access and receive a copy of your personal data, to ask us to correct any errors, to erase your personal data to restrict how your information is processed.

Our commitment to Children’s Privacy

Protecting the privacy of young people is important to us. Hence our website services does not address anyone under the age of 16 (“Children”) without parental consent. By accessing the website at www.empoweringmindtherapies.co.uk and providing your personal data you are warranting that you are over 16 years of age. We do not knowingly collect personally identifiable information from anyone under the age of 16 on our website. If you are a parent or guardian and are aware that your child has provided us with Personal Data, please contact us. (“We, Us”) will always ensure that we stop the processing of your data if you object to us doing so and we will always offer an opt out option.

Empowering Mind Therapies reserves the right to change this privacy policy, alter or amend it as we deem necessary or as required by law. From time to time without prior notice. Any changes will be immediately posted on the Empowering Mind Therapies website. Your first use of our website after the date of any amendments or alterations will constitute your acceptance of such changes therefore, we recommend you review our Privacy Policy regularly to keep informed of any changes. This Privacy Notice Policy is reviewed annually to ensure that any additions or amendments can be implemented to meet the requirements under the General Data Protection Regulation (GDPR).
